Age Discrimination Compensation

In an age that boasts equality, it's seems almost absurd to think that someone would be denied their just compensation because of their age. The truth is that there are many different forms of age discrimination. Compensation is only one of them. The Equal Pay Act of 1963, Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act of 1967, and Title I of the Americans with Disabilities Act of 1990 all address the issue of discrimination. These laws cover all types of compensation including salary, overtime pay, bonuses, stock options, profit sharing and bonus plans, life insurance, vacation and holiday pay, cleaning or gasoline allowances, hotel accommodations, reimbursement for travel expenses, and benefits. It is illegal in the United States to discriminate against a person with regard to their salary and other benefits, because of their age or any other reason. This unjust difference in compensation is referred to as a differential.

Fast Facts

  • If a pay differential is found, and requires correcting, the discrepancy is resolved by the lower paying employees salaries (or whatever financial area of employment has been found to be question) being increased rather than the other employee(s) benefits being decreased.
  • The only situation in which a pay differential is permitted is on seniority, merit, quantity or quality of production, or a factor other than sex.
