Age Discrimination Layoff

Do you feel you're being hit hard with age discrimination? Layoff for the right reasons is acceptable, but dismissing someone from their job because of their age is not only wrong, it's against the law. There use to be a time when older workers were sought after. They had more experience than the younger generation, and they were valuable in the training of the up and coming apprentices who wanted to learn their trade. Today, age discrimination is an issue that can be found in almost all areas of the workforce. For many employers, the older generation means higher insurance costs, pension payouts and, in some cases, longevity credits that can cut deep into a company's pocketbook. The younger generation will rarely make the salary of a seasoned worker, and this only serves to benefit the employer. Congress has addressed the issue of age discrimination by passing the Age Discrimination in Employment Act (ADEA). This act is designed to make it illegal to discriminate against employees or potential employees based on their age. And, even though it has been around since 1967 many people are still affected by age discrimination each year.

Fast Facts

  • The ADEA only applies to businesses that have 20 or more employees.
  • The ADEA prohibits discrimination against persons over the age of 40 based on their age.
