Age Discrimination Layoffs

In spite of the ADEA (Age Discrimination in Employment Act) many people are still victims of age discrimination. yoffs, hiring criteria, and even harassment from fellow employees, are all areas of the workforce where age discrimination still exists. The ADEA law covers all employees that work for a business with at least twenty employees. In addition, if you are over 40, and are chosen for an early incentive buyout, your employer must provide you with a disclosure that lists the ages and job titles for all other employees that were eligible for the program. The disclosure must also show all employees that were actually selected for the program. In addition to this incentive disclosure, if you are asked to sign a waiver or release of claims agreement, your employer must be certain to specify certain things in the agreement. They include, but are not limited to, a written account of your ADEA rights, statement that future claims will not be prejudice, advise you to seek legal advice before signing the waiver, and provide you with no less than 21 days in which to consider the agreement, and no less than 7 days to change your mind after signing it.
