Age Discrimination Promotion

Unfortunately, people are still affected by age discrimination. Promotion, training, benefits and other areas of employment are situations in which a person can be discriminated against simply because of their age. Hence the phrase "age discrimination". Promotion is an area of employment that, more often than not, means a bigger salary, and more benefits, both of which the employer must pick up the tab for. It may be cheaper in the long run for an employer to promote a younger employee rather than an older one. This, however, is absolutely against the law. More specifically, against the language of the Age Discrimination in Employment Act (ADEA) which every employer must abide by if they want to do business in the United States.

Fast Facts

  • The ADEA was enacted in 1967, and is specifically designed to address the issue of age discrimination in the workplace.
  • A person cannot be discriminated against when it comes to promotions, raises, benefits, training, job requirements and other like areas because of their age.
  • A job notice or advertisement may specify an age limit, but only in situations where age is shown to be a "bona fide occupational qualification" (BFOQ) reasonably necessary in order to sustain normal operation of the business.
