Age Discrimination Workforce

Even though we live in the twenty-first century, thousands of older individuals are still victims of age discrimination. Workforce after workforce all over the United States has many older people that are struggling with the issue of age discrimination. The Age Discrimination in Employment Act (ADEA) is aimed at eliminating age discrimination. The ADEA was enacted in 1975, and the Older Workers Benefit Act (OWBPA) of 1990 further ensured an older workers right to not have benefits withheld from them due to their age. Some states have even enacted laws that also govern age discrimination in the workplace. Age discrimination is a serious matter that states and governments have tried to address, and it should never be brushed under the carpet.

  • The United States Supreme Court, as of yet, is undecided on the issue of age harassment and whether a person affected by it can sue someone under the ADEA. Many appellate and trial courts have already established that age harassment does indeed exist.
