Employer Age Discrimination

The specific ways in which a person is subjected to age discrimination varies from employer to employer. Age discrimination, in any form, is illegal and should always be reported. The Age Discrimination in Employment Act of 1967 (ADEA) is designed to give persons 40 years of age and older the same rights and benefits that their younger co-workers are entitled to in the workforce. It addresses issues such as, condition of employment, privileges that come along with employment, hiring, firing, promotion, benefits, compensation, training, job assignment and layoff. The ADEA also protects the older person who has applied for a job. In addition to these regulations, the ADEA makes it illegal for an older employee to be retaliated against when they report age discrimination by their employer. Age discrimination is not as prevalent as it once was, but it is still an issue for thousands of older employees every year.

Fast Facts

  • Age limitations with regard to apprenticeship programs are sometimes valid, but only if they fall within certain specific exceptions under the ADEA or if the EEOC approves a specific exemption.
