Since January 1, 2000, the law requires all agencies to create or institute an alternative dispute resolution (ADR) or mediation program. Such a process must be furnished during the pre-complaint stage and the formal complaint process. Such a program must be available for both the pre-complaint process and the formal complaint process. The Code of Federal Regulations requires counselors to inform individuals at the first counseling session of their right to choose between EEO counseling and participation in mediation. If the claim is not settled through ADR within 90 days of the date that the complainant contacted the EEO office, the individual receives a Notice of Final Interview allowing him or her to file a formal complaint.
