There are various causes of age discrimination in the workplace, employer retaliation, harassment of older workers to force an early retirement, hiring a younger worker at a lower salary than paid to the older worker, forcing an older worker to quit and lose his retirement benefits, the list is almost as endless as the illegal tactics of a hardnosed employer.

The federal Age Discrimination in Employment Act (ADEA) prohibits employers from discriminating against employees and applicants who are 40 years of age or older on the basis of their age.  The ADEA prohibits discrimination in all phases of the employment except benefits and early retirement.  The aspects of the employment relationship that the ADEA governs include: help-wanted ads, interviewing, hiring, compensation, promotion, discipline, job evaluations, demotion, training, job assignments and termination.  If an employer engages in age discrimination retaliation against an employee for requesting a disability accommodation or reporting illegal age discrimination acts to the appropriate authorities that employer has violated that employee’s civil rights.

Age discrimination harassment may include such acts as frequently teasing an employee based on his age to the extent that a hostile work environment forms causing that employee to quit or alter his employment plans due to emotional distress caused by the employers actions. 

EEOC Enforcement of Anti-Discrimination Laws

The EEOC, Equal Employment Opportunity Commission, enforces the ADEA, Age Discrimination in Employment Act.  Any individual who believes that they have suffered EEOC age discrimination may file a complaint with the Equal Employment Opportunity Commission and the incident will be fully investigated and action taken to enforce the employee’s rights against the employer.
